ACCEPTING GRANT OF EASEMENT FROM ALAMEDA BELT LINE
AND CONSENTING TO THE RECORDATION THEREOF
(BOND ISSUE SEWERS - UNIT V)
WHEREAS, a certain indenture dated the 28th day of May, 1953, made by
and between Alameda Belt Line,, a California corporation, Grantor, and City of
Alameda, a municipal corporation,, Grantee, was, on or about said date, executed and
delivered. by said Grantor to the City of Alameda, and
WHEREAS., by said indenture., the grantor granted to the City of Alameda an
easement and right of way for the purpose of laying down, constructing, reconstructing,
removing, replacing, repairing, maintaining., operating, and using, a portion of a system
of underground sanitary or storm sewer lines, and all necessary appurtenances, in,
under, along and across that certain real property in the City of Alameda, County of
Alameda, State of California, and. more particularly described in said indenture
(East side of Fifth Street -Project Cal 4114 -Chipman); and
WHEREAS, the City of Alameda did, on the 3rd day of June, 1953, accept said
conveyance and acquired possession of the said easement in the said real property;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that
the aforementioned indenture be,, and the same is hereby, accepted on behalf of the
City of Alamed.a, and said City Council, acting for and in behalf of said City, hereby
consents to the recordation of said indenture and orders this resolution to be
attached thereto., as required by Section 27281 of the Government Code of the State
of California.
I, the undersigned, hereby certify that the foregoing Resolution was
duly and regularly introduced and adopted by the Council of the City of Alameda in
adjourned regular meeting assembled on the 3rd day of June, 1953, by the following
vote, to wit:
AYES: Councilmen Anderson, Jones, McCall., Moresi and, President
Sweeney, (5).
