Resolution 15994CITY OF ALAMEDA RESOLUTION NO. 15994 AMENDING THE FISCAL YEAR 2022-23 CAPITAL IMPROVEMENT BUDGET BY APPROPRIATING $900,000 IN HARBOR TRANSPORTATION FUNDS (287) FOR BUS SHUTTLE STOP IMPROVEMENTS AND SIGNAGE IN HARBOR BAY BUSINESS PARK WHEREAS, on April 4, 1989, the City of Alameda (City), Harbor Bay Isle Associates, Harbor Bay Village Four Associates, and Harbor Bay Village Five Associates entered into an Infrastructure Agreement, which addressed issues involving traffic and access to Bay Farm Island and Harbor Bay Isle, as well as "Traffic Improvement Projects" to mitigate such issues; and WHEREAS, the Infrastructure Agreement provides for the allocation of certain taxes to be set aside in the "Traffic Improvement Fund," also known as the Harbor Transportation Fund (287), to fund "Traffic Improvement Projects" involving Bay Farm Island and Harbor Bay Isle as set forth in Exhibit "A" of the agreement; and WHEREAS, the Infrastructure Agreement was amended on October 1, 2019 where Harbor Bay Isle Associates assigned to Harbor Bay Business Park Association its rights and obligations under the Infrastructure Agreement, and Harbor Bay Business Park Association accepted and assumed such rights and obligations under the Infrastructure Agreement; and WHEREAS, the October 1, 2019 Infrastructure Agreement amendment also modified the schedule of Traffic Improvement Projects included in Exhibit "A" of the agreement; and WHEREAS, the City and Harbor Bay Business Park Association are to meet and confer each year on potential updates to the schedule of Traffic Improvement Projects and review financial activity related to the Traffic Improvement Funds; and WHEREAS, in 2022 the City and Harbor Bay Business Park Association met, conferred, and mutually agreed that certain modifications to the schedule of Traffic Improvement Projects included in Exhibit "A" of the agreement are required; and WHEREAS, sufficient fund balance is available in the Harbor Transportation Fund for bus shelter and signage improvements; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda that the appropriation of $900,000 in Harbor Transportation Funds to the Fiscal Year 2022-23 Capital Improvement Program Budget is approved. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in a regular meeting assembled on the 1st of November 2022 by the following vote to wit: AYES: Councilmembers Daysog, Herrera Spencer, Knox White, Vella and Mayor Ezzy Ashcraft — 5.
