Resolution 16108 CITY OF ALAMEDA RESOLUTION NO. 16108 AMENDING THE FISCAL YEAR 2023-24 GENERAL FUND BUDGET TO APPROPRIATE $100,000 FROM GENERAL FUND RESIDUAL FUND BALANCE FOR THE TEMPORARY RELOCATION TENANT ASSISTANCE PROGRAM WHEREAS, the City has adopted an Ordinance entitled the City of Alameda Rent Control, Limitations on Evictions, and Relocation Payments to Certain Displaced Tenants Ordinance ("the Rent Control Ordinance"); and WHEREAS, the Rent Control Ordinance requires landlords to make Temporary Relocation Payments to a tenant who, among other reasons, (i) has vacated or is ordered to vacate a rental unit in compliance with an order from a governmental agency or from a court of competent jurisdiction, or (ii) vacates a rental unit temporarily due to Health or Safety Conditions; and WHEREAS, tenants who are temporarily displaced as provided in the Ordinance have an immediate need for financial assistance in order to provide for temporary housing, meals, and the like; and WHEREAS, requiring landlords to provide such relocation payments helps mitigate the challenges faced by tenants who must vacate a rental unit through no fault of their own; and WHEREAS, when a landlord fails immediately to comply with this requirement, it creates a financial burden for the tenant and the potential for the tenant to become unhoused; and WHEREAS, it is in the public interest to provide assistance and financial stability to tenants who face temporary displacement where the landlord is unwilling or unable to provide immediately Temporary Relocation Payments to an affected tenant; and WHEREAS, it is in the public interest to establish a Temporary Relocation Tenant Assistance Program to provide tenants with the Temporary Relocation Payments to which they are entitled and, to the extent such financial assistance is provided, the City will seek recovery of such funds from the landlord. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALAMEDA AS FOLLOWS: Section 1. The proposed amendment to the Fiscal Year 2023-24 General Fund Budget to appropriate $100,000 from the General Fund Residual fund balance to establish a Temporary Relocation Assistance Program is approved. Section 2. This Resolution is effective immediately upon adoption.
