Resolution 16122 CITY OF ALAMEDA RESOLUTION NO. 16122 AUTHORIZING THE CITY MANAGER TO EXECUTE A SECOND AMENDMENT TO A PROJECT FUNDING AGREEMENT WITH THE ALAMEDA COUNTY TRANSPORTATION COMMISSION FOR AN AMOUNT NOT-TO-EXCEED $6,376,000 TO COMPLETE THE CONSTRUCTION PHASE OF THE CLEMENT AVENUE/TILDEN WAY PROJECT AND TO EXTEND THE EXPIRATION DATE TO DECEMBER 31, 2026; AND AUTHORIZING SUBMITTAL OF THE SAFE ROUTES TO BAY AREA RAPID TRANSIT GRANT APPLICATION TO FUND THE FULL BUILD-OUT OF THE CLEMENT AVENUE/TILDEN WAY PROJECT, WHICH PRIMARILY IMPROVES THE BROADWAY/TILDEN WAY INTERSECTION, FOR AN AMOUNT NOT-TO-EXCEED $3,000,000 WHEREAS, the City of Alameda ("City") is eligible to receive Measure BB funding to implement complete street improvements for the Clement Avenue/Tilden Way ("Clement/Tilden") project, through the Alameda County Transportation Commission ("Alameda CTC"); and WHEREAS, on April 27, 2017, Alameda CTC and the City entered into a Project Funding Agreement (Agreement) for the Clement/Tilden project; and WHEREAS, on March 15, 2021, the parties entered into an Amended and Restated Project Funding Agreement (Amendment No. 1); and WHEREAS, the parties now seek to enter into an Amendment No. 2 to the Agreement (Amendment No. 2) to enable the City to claim construction funds and to extend the expiration date of the Alameda CTC Measure BB funds to December 31, 2026; and WHEREAS, the City Council of the City of Alameda wishes to delegate authorization to execute this Amendment No. 2 and any further amendments to the Agreement to the City Manager; and WHEREAS, to construct the full project, additional funds are needed to improve the Broadway/Tilden Way intersection; and WHEREAS, City staff proposes to submit a Safe Routes to Bay Area Rapid Transit ("BART") grant application to BART for an amount not-to-exceed $3,000,000. NOW, THEREFORE, BE IT RESOLVED, that the City agrees to accept and comply with Amendment No. 2 to obtain $6,376,000 in Alameda CTC administered Measure BB funds for the construction phase of the Clement/Tilden project; and BE IT FURTHER RESOLVED, that the City Council of the City of Alameda hereby authorizes its City Manager, or designee, to execute this Amendment No. 2 and any further amendments to the Agreement; and BE IT FURTHER RESOLVED, that the City Council authorizes submittal of the Safe Routes to BART grant application to fund the Broadway/Tilden Way improvements.
