Ordinance 3362 CITY OF ALAMEDA ORDINANCE NO. 3362 New Series AUTHORIZING THE CITY MANAGER TO EXECUTE A 12-MONTH LICENSE WITH LITTLE OPERA HOUSE, INC. FOR THE USE OF 2.13 ACRES OF PROPERTY ON PAN AM WAY AT ALAMEDA POINT FOR TEMPORARY PERFORMING ARTS AND SPECIAL EVENTS WHEREAS, the City is the owner of certain real property located within the City of Alameda, State of California commonly referred to as the former Alameda Naval Air Station, now known as Alameda Point, which includes approximately 2.13 acres property identified as Blocks 12 & 13 in Site A Development Plan and located in the Transit Village Center planning subarea of the Waterfront and Town Center Precise Plan; and WHEREAS, in 2014, the Alameda City Council approved a Master Infrastructure Plan, General Plan Amendment, Zoning Ordinance Amendment, Waterfront and Town Center Precise Plan and certified an Environmental Impact Report; and WHEREAS, in 2022, City Counci! approved the amended Site A Development Plan and Disposition and Development Agreement, which identifies Block 12 & 13 for a Performing Arts use; and WHEREAS, Little Opera House, Inc. seeks to continue temporary use of the property for temporary perform ng arts events and exhibitions. NOW, THEREFORE, the City Council of the City of Alameda does hereby ordain as follows: Section 1. The City Manager of the City of Alameda is hereby authorized to execute on behalf of the City of Alameda, a license agreement with Little Opera House, Inc, for 12 months for use of City property on Pan Am Way for temporary performing arts events and exhibitions, subject to such technical or clarifying revisions as are reasonably determined necessary by the City Manager and approved by the City Attorney, and the City Clerk is hereby authorized and directed to attest to the same. Section 2. If any section, subsection, sentence, clause or phrase of this ordinance if, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council of the City of Alameda hereby declares that it would have passed this ordinance, and each section, subsections, clause, or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases are declared to be invalid and unconstitutional. Section 3.
