Resolution 16144 CITY OF ALAMEDA RESOLUTION NO. 16144 ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE PERTAINING TO CANDIDATE STATEMENTS SUBMITTED TO THE VOTERS AT AN ELECTION AND RESCINDING RESOLUTION NO. 12795 WHEREAS, Section 13307 of the Elections Code of the State of California provides that the governing body of any local agency can adopt regulations pertaining to materials prepared by any candidate for a municipal election, including costs of the candidate's statement. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Alameda does hereby resolve, declare, determine and order as follows: Section 1. That Resolution No. 12795 is hereby rescinded. Section 2. GENERAL PROVISIONS. That pursuant to Section 13307 of the Elections Code of the State of California, each candidate for elective office in the City of Alameda may prepare a candidate statement on an appropriate form provided by the City Clerk. The statement may include the name, age and occupation of the candidate and a brief description of no more than 200 words of the candidate's education and qualifications expressed by the candidate. The statement shall not include party affiliation of the candidate nor membership or activity in partisan political organizations. The statement shall be filed in the office of the City Clerk at the time the candidate's nomination papers are filed. The statement may be withdrawn, but not changed, during the period for filing nomination papers and until 5:00 p. m. on the next working day after the close of the nomination period. Section 3. FOREIGN LANGUAGE POLICY. That pursuant to the Federal Voting Rights Act, candidate statements will be translated into all languages required in the County of Alameda. The County will mail separate voter information guides and candidate statements in languages to voters who are on the County voter file as having requested a voter information guide in a particular language. The County will make the voter information guides and candidate statements in the required languages available at all polling places/vote centers, on the County's website and in the office of the City Clerk. All translations shall be provided by professionally certified translators. Section 4. PAYMENT. That the candidate shall only be required to pay $1,000 of the total cost of printing, handling, translating (into all languages required in the County of Alameda pursuant to federal and/or State law) and mailing the candidate statements filed pursuant to this section, including costs incurred as a result of complying with the Voting Rights Act of 1965 (as amended). Each candidate filing a statement is required to pay a $100 deposit at the time of filing as a condition of having their statement included in the voter information guide with the remaining $900 billed after the election. If the final actual costs are lower than $1,000, the City Clerk shall refund any excess paid. Section 5. PRIOR NON-PAYMENT. That any candidate with a balance due from a prior election is required to submit the full $1,000 at the time of filing the statement. Section 6. That this resolution shall apply at the next ensuing municipal election and at each municipal election after. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in a regular meeting assembled on the 2nd day of April 2024, by the following vote to wit: AYES: Councilmembers Herrera Spencer, Jensen, Vella and Mayor Ezzy Ashcraft—4.
