2001-07-17 Regular CC MinutesMINUTES OF THE REGULAR CITY COUNCIL MEETING TUESDAY - - JULY 17, 2001 - - 7:30 P.M. Mayor Appezzato convened the Regular City Council Meeting at 7:36 p.m. Councilmember Daysog led the Pledge of Allegiance. Elder John Pillitiere, Alameda Chapel, gave the Invocation. ROLL CALL - Present: Councilmembers Daysog, DeWitt, Johnson, Kerr and Mayor Appezzato -5. Absent: None. AGENDA CHANGES (01 -374) Mayor Appezzato announced that the Public Hearing to consider an Appeal of the Planning Board's Finding for a proposed Commercial Office Complex at the Bridgeside Shopping Center located at 2523 Blanding Avenue [paragraph no. 01 -394] was being held over at the request of the Appellant. PROCLAMATIONS, SPECIAL ORDERS OF THE DAY AND ANNOUNCEMENTS (01 -375) Mayor Appezzato stated the City has been served well by Diane Felsch, City Clerk; presented flowers, on behalf of the City of Alameda and all its citizens, to Ms. Felsch. Councilmember Kerr presented Ms. Felsch with flowers. Mayor Appezzato inquired whether Ms. Felsch would like to say a few words; stated Ms. Felsch's performance over the years has said it all. City Clerk Diane Felsch stated it has been a privilege and honor to serve the City Council and citizens of Alameda. Councilmember Kerr stated newly elected Councilmembers have been served well by Ms. Felsch, who always goes the extra mile. CONSENT CALENDAR Mayor Appezzato stated that as long as there was no objection from Councilmembers, he would like to consider the Resolution Acknowledging City Clerk Diane Felsch for Her Contributions to the City of Alameda [paragraph no. 01 -388] at this time. There being no objection, Councilmember Johnson moved adoption of the Resolution. Regular Meeting Alameda City Council 1 July 17, 2001 Councilmember Daysog seconded the motion, which carried by unanimous voice vote - 5. Mayor Appezzato read the Resolution and presented it to Ms. Felsch. PROCLAMATIONS, SPECIAL ORDERS OF THE DAY AND ANNOUNCEMENTS (01 -376) Proclamation declaring July 17, 2001 as Emily R. Schultheis Day. Mayor Appezzato read the Proclamation and presented it to Ms. Schultheis. (01 -377) Proclamation declaring August 5, 2001 as National Kids Day. Mayor Appezzato read the Proclamation and presented it to George Phillips, Boys & Girls Club. (01 -378) Presentation by Park Street Business Association on the Annual Art and Wine Faire. Robert and Tracy McKean, Co- Chairs of the Art and Wine Faire, announced that the Faire is August 4 and 5; presented the Mayor, Councilmembers and City Manager with special edition glasses. (01 -379) Mayor Appezzato announced that there was a ribbon cutting and dedication for implementation of Phase 2 of the Fire Department Advanced Life Support Program today; now, all three ambulances have two qualified paramedics aboard; Phase 3 will be completed when one qualified paramedic is aboard every fire engine; complimented the Fire Department for the achievement. (01 -380) Mayor Appezzato announced that the Metropolitan Transportation Commission (MTC) will consider awarding an approximately $900,000 grant to the West Alameda Business Association (WABA) for improvements on Webster Street; stated MTC's Planning and Allocations Sub - Committee unanimously voted to award the grant to WABA; MTC will vote on the matter July 25. CONSENT CALENDAR Mayor Appezzato announced that the recommendation to authorize the City Manager to execute a Memorandum of Understanding between the City of Alameda and American Tower Corporation [paragraph no. 01- 387] was removed from the Consent Calendar for discussion. Councilmember Johnson moved approval of the remainder of the Regular Meeting Alameda City Council 2 July 17, 2001 Consent Calendar. Vice Mayor DeWitt seconded the motion, which carried by unanimous voice vote - 5. [Items so enacted or adopted are indicated by an asterisk preceding the paragraph number.] ( *01 -381) Minutes of the Special and Regular City Council Meetings held on July 3, 2001. Approved. ( *01 -382) Recommendation to support the purchase of an Electronic Touchscreen Voting System by Alameda County. Accepted. ( *01 -383) Recommendation to amend the FY 2001 -02 General Fund Budget for the Planning and Building Department. Accepted. ( *01 -384) Recommendation to extend the Amnesty Program for Legalization of Undocumented Construction for 18 months to conduct a Feasibility Study on the merits of making the Program permanent. Accepted. ( *01 -385) Recommendation to award Contract for Design Services in the amount not to exceed $289,000 to Whitley Burchett and Associates, Inc. for Alameda Point Water System Upgrades, Phase 1, No. P.W. 02- 01 -04. Accepted. ( *01 -386) Recommendation to appoint Deputy City Clerk Lara Weisiger as Acting City Clerk effective July 18, 2001. Accepted. (01 -387) Recommendation to authorize the City Manager to execute a Memorandum of Understanding between the City of Alameda and American Tower Corporation regarding negotiation of Master Lease for the installation of Telecommunication Transmission Facilities. Randy Potter, Green Party, stated there should be more public input on the issue; that he opposes placing antennae in parks; microwave radiation might be dangerous to young people; the City should learn whether there are dangers before moving forward; independent studies should be reviewed; urged Council to review all data; further stated children's health should be protected; improved cellular phone communication is not that worthy of a goal. Councilmember Johnson stated the Planning Board will have to approve the location of each antenna, which will provide additional opportunity for public input. Councilmember Daysog noted research on the impacts of radio Regular Meeting Alameda City Council 3 July 17, 2001 frequency waves is mixed. Steven Gerstle, Alameda, stated there is controversy throughout the country about possible health effects, aesthetics and impacts on neighborhoods; homes in the immediate vicinity will loose property value; options should be explored; antennae could be located in areas of the City other than parks; parks are for recreation and relaxation. Peter Lenhardt, Alameda, stated studies are mixed; until there is conclusive evidence, cities should follow a policy of precaution and prudence; if studies [on antennae] are not favorable, there could be lawsuits; locating towers in parks makes the issue public; private organizations and businesses can earn money by offering property; aesthetically, parks are meant to be havens; placing towers in parks turns them into places of business. Len Grzanka, Alameda, stated the private sector should not be closed off from participating in leases; a church in his neighborhood is interested in allowing its steeple to be used as a telecommunication tower; private sector land owners might want to place telecommunication towers on their property; the City Manager should open bidding to the private sector, including non - profit and commercial interests. Mayor Appezzato stated the City is involved to control the quality and location of antennae; there could be a proliferation of towers if allowed on private property; several years ago, a major antenna was allowed in a neighborhood because the City had no control; one company, rather than ten, can provide wireless communication for every cellular phone. Nicholas Chung, Trans Pacific National Bank, not present; submitted a speaker slip in favor of the staff recommendation. Floyd Hibbits, President, Chamber of Commerce, stated there have been no cases of diminution in value of towers located in the State of California; the Chamber unanimously supports moving forward with the Memorandum of Understanding. George Phillips, Boys & Girls Club, stated people providing child care need to have the ability to communicate in the event of emergencies; the City should analyze the best way to move forward. Mayor Appezzato stated everyone uses cellular phones; requested staff to review whether using a cellular phone is dangerous. Lynn Faris, Alameda Civic Light Opera (ACLO), stated that she supports the staff recommendation; there should be good cellular Regular Meeting Alameda City Council 4 July 17, 2001 phone coverage for emergency purposes; during a rehearsal at Alameda Point, there was a theft of expensive musical equipment; due to poor cellular phone reception, the theft could not be reported directly to the Police Department; many people are dependent on cellular phones. Mayor Appezzato requested that when the matter returns to Council, a technical expert be present to address health concerns. Councilmember Daysog requested that the Memorandum of Understanding include language allowing the agreement to be rescinded if scientists determine antennae are harmful to health. Susan Irvine, Alameda, not present; submitted a speaker slip in favor of the staff recommendation. Moira Fossum, Alameda, stated Alameda has poor wireless communication; when possible, American Tower will use existing poles; antennae will be as unobtrusive as possible. Mayor Appezzato requested an assessment of similarities and differences between telecommunication transmission antennae and current television and radio antennae when the matter returns to Council. Jim Franz, Alameda, stated that he experiences daily frustration using his cellular phone; during the recent fire at Minturn Street and Lincoln Avenue, he had to walk almost a block away from the fire to use his cellular phone; in order to present awards at the 4th of July Parade, ham radios had to be used because cellular phones are not reliable; poles on the perimeter of parks could be used, which would not effect aesthetics. Kay Guffy, Alameda, stated not having dependable cellular communications hinders Alameda's attempts to attract businesses; in a disaster or emergency, cellular communication becomes of utmost importance. Mayor Appezzato stated newspaper articles indicate Alameda appears to be one of the worst communities for cellular reception; requested an explanation when the matter returns to Council. The City Attorney stated that her cellular provider indicated poor reception is due to Alameda being surrounded by water. Councilmember Kerr noted the staff report cites too many trees as a reason for poor reception. Regular Meeting Alameda City Council 5 July 17, 2001 Robb Ratto, Park Street Business Association, stated the concept should move forward; staff and the Planning Board should go through the public review process to work toward better cellular phone reception; there is no service at Alameda Point; health and safety concerns can be addressed. Janice Graham, Alameda, stated that she has a cellular phone for her safety when she is walking or driving; service is intermittent; urged Council to find a prudent way to move forward. Debra Ammirata, Alameda, did not wish to speak, but submitted a speaker slip in favor of the staff recommendation. Ronald Basarich, Alameda, did not wish to speak, but submitted a speaker slip in favor of the staff recommendation. Mayor Appezzato questioned whether there would be a proliferation of antennae if the City did not move forward and whether moving forward might result in a reduction of antennae; stated the City can control the number of sites, safety and aesthetics; there will be hearings before the Planning Board. Councilmember Johnson stated 911 calls from cellular phones go to the Highway Patrol; inquired whether 911 cellular phone calls could be directed to the City's 911 dispatch; further stated her cellular phone calls always fade out. Councilmember Johnson moved approval of the staff recommendation to allow the City Manager to proceed with negotiations, while keeping in mind comments and concerns raised tonight. Vice Mayor DeWitt seconded the motion. Under discussion, Vice Mayor DeWitt stated the staff recommendation merely gives the City Manager permission to address service and perhaps negotiate [antennae] locations and terms; this is only the first step. Councilmember Johnson noted the number of antennae is approximately 12. Councilmember Daysog stated the City Council should bring cellular lines to the entire City, while keeping with health concerns front and center; that he supports the staff recommendation. Councilmember Kerr stated the Planning Board should not be last in line; the Master Lease will be defined in the Memorandum of Understanding (MOU); the Master Lease language could make Planning Regular Meeting Alameda City Council 6 July 17, 2001 Board hearings irrelevant; if leases are in place, with terms and sites decided upon, the Public Hearings appear to be after everything has been decided; if the Master Lease contents are determined after Planning Board hearings, she would support the staff recommendation; if an up to 120 -foot tower is proposed in an area, Planning Board hearings provide notice to the neighborhood; there is a lattice tower at Alameda Point; another 120 -foot tower is proposed on Central Avenue south of Pacific Avenue; requested the motion be amended to include language which would not preclude Planning Board hearings. Mayor Appezzato stated the Planning Board should have criteria to review; the Planning Board will have the option to review everything; the City Council can make revisions when the matter returns to Council; there will be public input at the Planning Board and City Council level. The Redevelopment Manager stated staff intends to allow the Planning Board to hold hearings on individual sites prior to bringing the Master Lease to Council for action; the staff report indicates the Planning Board hearings will take place prior to Council action, however, corresponding language was not included in the MOU itself. The City Manager stated staff is committed to ensuring that the Planning Board conducts hearings on every site contained in the proposed Master Lease. Councilmember Kerr inquired whether language could be added to the MOU indicating hearings will be held at the Planning Board level before the Master Lease is signed. In response to previous comments addressing health concerns, Councilmember Daysog stated Sections 8(b)(13) and 8(b)(14) of the MOU address issues of collecting data on heath issues, e.g. termination and non - ionizing radiation exposure. In response to Councilmember Kerr's comments about Planning Board hearings, Mayor Appezzato noted the staff report states: "specific site information will be submitted and reviewed publicly as part of the Planning Department's review and approval process." The City Manager stated the City Attorney suggested that the language in the staff report under "Next Steps" be added to the MOU. Councilmember Kerr stated the addition of said language would satisfy her; inquired whether the motion could be amended. Regular Meeting Alameda City Council 7 July 17, 2001 There being no objection, Mayor Appezzato stated the motion was so amended [added MOU Condition 19: Following approval of the MOU, American Tower would submit an application to the Planning Department for review and approval per Zoning requirements. Structures to be located in parks and structures which would exceed existing height limits in residential areas would require a Use Permit (which involves publicly noticed hearings), and the approval of the Master Lease for Phase I would be subject to environmental review. Meanwhile, real property negotiations on business terms of the Master Lease would proceed and would be subject to closed sessions with Council. A proposed Master Lease would be brought to Council at a public meeting for review and final approval following Planning Board action on use permits and the environmental review determination]. On the call for the question, the motion carried by unanimous voice vote - 5. (01 -388) Resolution No. 13371, "Acknowledging City Clerk Diane Felsch for Her Contributions to the City of Alameda." Adopted. At the beginning of the meeting, Mayor Appezzato read and presented the Resolution to City Clerk Diane Felsch. ( *01 -389) Resolution No. 13372, "Affirming Support for City of Alameda Rent Review Advisory Committee." Adopted. ( *01 -390) Resolution No. 13373, "Authorizing Execution, Delivery and Performance of Third Party Security Agreement: Specific Rights to Payment, with Wells Fargo Bank, National Association, for the Benefit of the Alameda Public Financing Authority and the Community Improvement Commission of the City of Alameda." Adopted. ( *01 -391) Ratified bills in the amount of $5,147,449.93. REGULAR AGENDA ITEMS (01 -392) Resolution No. 13374, "Appointing Ruth K. Belikove as a Member of the City Library Board." Adopted. Vice Mayor DeWitt moved adoption of the Resolution. Councilmember Daysog seconded the motion, which carried by unanimous voice vote - 5. (01 -395) Public Hearing to consider an Appeal of the Planning Board's approval of Use Permit, UP 01 -07, and Major Design Review, DR 01 -034, which requires a 15 -foot shoreline trail right -of -way as a condition of a project to reconfigure 15,000 square feet of docks for 41 houseboats and 14 pleasure craft in an existing marina in the E, Estuary, Zoning District; to relocate a 600- square -foot modular office building, restripe 99 parking spaces, install a shoreline public trail and landscaping; and to allow existing unenclosed land uses including outdoor storage in the M -2, General Industrial (Manufacturing) Zoning District; and adoption of related Resolution. The site is located at 2394 Mariner Square Drive and contains 5 acres of land, 2 acres of water area and is within the Business and Waterfront Improvement District. Appellant: A.V. Barnhill, Barnhill Marina; and (01 -395A) Resolution No. 13375, "Sustaining the Planning Board's approval of Use Permit and Major Design Review with condition for Shoreline Trail, and denying appeal by A.V. Barnhill of condition regarding Shoreline Trail, for Barnhill Marina, 2394 Mariner Square Drive." Adopted. Mayor Appezzato opened the public portion of the Hearing. Proponent: A.V. Barnhill, Barnhill Marina. There being no further speakers, Mayor Appezzato closed the public portion of the Hearing. Mayor Appezzato stated that he will support the Planning Board's decision; the Planning Director will work to accommodate Mr. Barnhill. Vice Mayor DeWitt requested staff to provide a brief overview of the Planning Board's discussion. The Development Review Manager stated the Planning Board supported the staff recommendation to require the 10- to 12 -foot width within the 15 -foot trail right -of -way; currently, the trail is not designed; there is flexibility to work with Mr. Barnhill to determine exact widths at various locations on the trail; after said decisions are made, Mr. Barnhill will have authority to appeal decisions; since the exact widths are not known, the current Appeal seems premature; staff should be able to resolve the matter with Mr. Barnhill. Mayor Appezzato stated cost seems to be Mr. Barnhill's main Regular Meeting Alameda City Council 10 July 17, 2001 concern. Councilmember Johnson moved approval of the staff recommendation to uphold the Planning Board's decision [adoption of Resolution Sustaining the Planning Board's approval of Use Permit and Major Design Review with condition for Shoreline Trail, and denying appeal by A.V. Barnhill of condition regarding Shoreline Trail, for Barnhill Marina, 2394 Mariner Square Drive]. Councilmember Kerr seconded the motion. Under discussion, Councilmember Kerr stated the City has worked diligently to connect the shoreline trail. On the call for the question, the motion carried by unanimous voice vote - 5. (01 -396) Final Passage of Ordinance No. 2860, "Authorizing Acquisition by Quitclaim Deed That Real Property at 2834 Adams Street, Alameda." Finally passed. Councilmember Kerr moved final passage of Ordinance. Vice Mayor DeWitt seconded the motion, which carried by unanimous voice vote - 5. ORAL COMMUNICATIONS, NON- AGENDA (01 -397) Cal Santare, Alameda, invited everyone to attend the Open House at Mastick Senior Center on Sunday, July 22 from 1:00 p.m. to 4:00 p.m. Councilmember Johnson encouraged families and friends to bring potential Mastick members to the Open House. COUNCIL COMMUNICATIONS (01 -398) Consideration of Mayor's nomination for appointment to the Social Service Human Relations Board. Mayor Appezzato nominated Stewart G. Chen for appointment to the Social Service Human Relations Board. (01 -399) Request for a recommendation from the Social Service Human Relations Board (SSHRB) on the Council Policy on Invocations at Regular City Council Meetings. Diane Libel, Green Party of Alameda, stated the current policy of Regular Meeting Alameda City Council 1 1 July 17, 2001 opening City Council Meetings with a religious Invocation should be changed to a moment of silence; although the practice of opening Government meetings with prayer is legal, it is not appropriate for a community as religiously and ethnically diverse as Alameda; the purpose of prayer before Council Meetings is to unite the community and conduct City business from a spiritual place; unfortunately, a religious invocation actually has the opposite effect; most prayers are Christian; a citizen attending only one Council Meeting is likely to feel excluded if he or she is not of the same faith as the minister offering the prayer; urged Council to discontinue prayers and have a moment of silence before meetings instead; further stated silence is universally valued by people of all faiths and of no faith and will include everyone. Mayor Appezzato stated a decision would not be made tonight; that he is asking the Council to vote to send the matter to the SSHRB for a recommendation. Julian Frederick, Alameda, stated that he supports the idea of a moment of silence, which seems to be the universal practice in Alameda County; a moment of silence can be filled individually and is open to all; meetings are for everyone, not one sect or another sect; for unity of the City, a moment of silence would be a good standard. Mayor Appezzato announced Mark Irons had a comment, but had to leave; requested the City Clerk to distribute copies of Mr. Irons' comments to the Councilmembers. Len Grzanka, Alameda, stated that the Invocation at the beginning of the meeting tonight was wonderful; local Buddhist Spiritual Leaders, Muslims and representatives of various faiths have given the Invocation at Council meetings; religion is important to Alameda's community; there are many churches in the City; urged Council to leave the spirit of religion in Alameda and begin City Council Meetings with a call to the higher power. Mayor Appezzato stated that he will ask the City Council to review Invocations; comments should be received from the SSHRB; Alameda is the only City in the East Bay that has Invocations; recently, the City of Burbank was sued over Invocations and the jury ruled against the City of Burbank having Sectarian Invocations; times, demographics and peoples change; the request tonight is to have the SSHRB provide comment. Vice Mayor DeWitt inquired when the City Council would act on the matter. Regular Meeting Alameda City Council 12 July 17, 2001 Mayor Appezzato stated the matter will come back; tonight, Council is requesting a recommendation from the SSHRB on the Council policy on Invocations at Regular Council Meetings. Vice Mayor DeWitt moved approval of the SSHRB providing a recommendation on the Council Policy on Invocations at Regular Council Meetings. Councilmember Johnson second the motion. Under discussion, Councilmember Daysog stated different models of Invocation should be considered; a city is more than just a set of streets, buildings and manicured lawns; Councilmembers have a responsibility to build understanding that there is a common good; the Invocation is an attempt to do so; there should be a breadth of different models of Invocation, e.g. poetry, different types of speakers, or moments of silence; the SSHRB will help flesh out all the issues; several friends have informed him that the Invocation has been a hurtful experience for them and they feel like they are not connected or part of the community. Councilmember Kerr inquired when the SSHRB would address the matter. The Community Development Manager stated the matter could be on the next [July 261 agenda. Councilmember Kerr stated that she would like to announce tonight when the matter will be heard by the SSHRB to notify people when they can provide their opinions to the Board. Councilmember Johnson inquired whether placing the matter on the July 26 agenda provides enough time; stated the recommendation should not be "yes" or "no," it should include alternatives on other respectful ways of commencing Council Meetings; there should be plenty of time to address the issue thoroughly. Councilmember Kerr stated the public should know when the matter will be heard. Mayor Appezzato suggested that the date be set and announced at the next City Council meeting; stated that he agrees with Councilmember Johnson's comments that there is no need to rush; the SSHRB should take its time and there should be sufficient notification. The Community Development Manager stated that she could check with the President of the SSHRB; the matter could be placed on the August agenda. Regular Meeting Alameda City Council 13 July 17, 2001 Mayor Appezzato stated that he would announce when the SSHRB would address the matter at the first [Council] meeting in August. In response to Councilmember Daysog's inquiry regarding the SSHRB already discussing the matter, the Community Development Manager stated the SSHRB has discussed the matter and is prepared to readdress the matter and review discussion and direction offered by Council tonight. Mayor Appezzato stated that unless requested by Council, the Board cannot bring the matter to Council because it is a Council policy; the correct process should be followed; Council is directing the SSHRB to provide a recommendation. The Community Development Manager stated there would be adequate opportunity given for public comment. Councilmember Kerr inquired whether the date when SSHRB would address the matter would be announced at the first Council meeting in August. Mayor Appezzato responded in the affirmative; stated if date has not been determined there would be an announcement at the following [Council] meeting; the whole community is aware of the matter; there have been at least two or three stories in the press; the City should ensure the word gets out. Councilmember Johnson inquired whether other options would be part of the SSHRB discussion, to which the Community Development Manager responded in the affirmative. (01 -400) Councilmember Daysog stated Joe Groom would like to place a sculpture at City Hall at Alameda Point; requested a memo on how decisions are made regarding said matter [public art]; provided Mr. Groom's telephone number to the Assistant City Manager, Operations. (01 -401) Councilmember Daysog thanked City Clerk Diane Felsch for providing wonderful service, including assisting with filing legally required State documents. (01 -402) Councilmember Kerr stated there has been misinformation in the print media regarding the first meeting on Alameda Point Master Developer selection; the meeting will be Thursday, July 19, at 5:30 p.m. in the Council Chambers. Regular Meeting Alameda City Council 14 July 17, 2001 (01 -403) Councilmember Johnson thanked Diane Felsch for being helpful to the Council, public and staff. (01 -404) Mayor Appezzato stated staff will present a new Agreement between the City, Alameda Reuse and Redevelopment Authority and the Alameda Unified School District; stated discussions with the School District should address anything the City can do to help schools; the School District should be in attendance when the Agreement is revised. (01 -405) Councilmember Kerr stated an amendment to the existing Agreement with the School District should be brought back in an open session, rather than a closed session; everybody should be able to participate in the discussion. The City Attorney stated any amendment to the Agreement would have to be discussed and voted on in open session. In response to Councilmember Kerr's inquiry whether the matter would be brought to Council in an open session, the City Attorney responded if the Agreement is desired to be amended, it would have to be amended in open session.
