Mayor Johnson convened the Special Meeting at 7:47 p.m. Councilmember Matarrese led the Pledge of Allegiance Roll Call - Present: Councilmembers Daysog, Kerr, Matarrese and Mayor Johnson - 4. Absent: None. (03 -396) Adoption of Resolution Appointing to the Office of Councilmember. Not adopted. The City Attorney reviewed City provision 2 -7 (C) applies to the sixty days [to fill the vacancy or l; three votes of the Council are than said requirement, the rules vacancy] are not prescribed by the Charter Section 2 -7; stated procedure tonight; stated the forfeit pay] expires September needed for appointment; other nd procedures [for filling the Charter. Mayor Johnson opened the public comment portion of the meeting. Kathy McIntire, Alameda, encouraged Council to appoint Jean Sweeney. Patricia Dilks, National Women's Political Caucus, stated the Alameda Chapter of the National Women's Political Caucus endorses Marie Gilmore. Diane Coler -Dark, Alameda, encouraged Council to appoint Jean Sweeney. Dr. Alice Challen, Alameda, encouraged Council to appoint Jean Sweeney. Barbara Kahn, Alameda, encouraged Council to appoint Marie Gilmore. Noel Folsom, Alameda, encouraged Council to appoint Jean Sweeney. Cary Dictor, Alameda, encouraged Council to appoint Jean Sweeney. Former Councilmember Lil Arnerich, Alameda, encouraged Council to appoint Jean Sweeney; noted Marie Gilmore, Georg Oliver and Doug deHaan were also qualified to fill the vacancy. Jon Spangler, Alameda, encouraged Council to appoint Marie Gilmore; noted Doug deHaan would be his second choice. Special Meeting Alameda City Council 1 August 26, 2003 Johanne Dictor, Alameda, encouraged Council to appoint Jean Sweeney. Austin Tam, Renewed Hope, encouraged Council to appoint Marie Gilmore. W. Jon Lambden, Alameda, encouraged Council to appoint Jean Sweeney. There being no further speakers, Mayor Johnson closed the public comment portion of the meeting. Mayor Johnson stated the Council created a process [at a Special Meeting July 22, 2003]; if an applicant is nominated and does not receive a second or receives less than three votes, the applicant will not be eliminated; the process will be: a nomination will take place; if there is a second, there will be a vote; if the nomination does not receive three votes, the nomination will fail, but the applicant will not be eliminated; the City Clerk will conduct roll call votes; until one applicant receives three votes, any applicant can be re- nominated; Council did not set specific rules on how the nomination process would occur; the same rules that apply to every other Council meeting apply tonight; as Mayor, she will acknowledge Councilmembers to make nominations; thanked the applicants; read the names of the thirteen applicants; encouraged those not appointed to stay involved in the community, run for office, or join a City board or commission. Vice Mayor Daysog inquired whether the order in which Councilmembers will make nominations is set. Mayor Johnson responded Council did not set a particular order; her intention was to provide the Vice Mayor the opportunity to make a nomination, followed by Councilmember Kerr and Councilmember Matarrese. Vice Mayor Daysog inquired whether a paper vote could be used instead of a roll call vote. Mayor Johnson stated the City Clerk has a normal procedure for roll call votes which will be followed. The City Attorney stated having paper voting is not illegal; however, she does not have knowledge of said voting procedure ever being used in Alameda; if Council chooses to use said voting method, the concurrence of two other Councilmembers should be obtained. Special Meeting Alameda City Council 2 August 26, 2003 Councilmember Kerr thanked everyone who applied for the position; stated voting by calling for all in favor and all opposed would keep Councilmembers from deciding based on the political weight of previous Councilmembers' votes. Councilmember Matarrese stated that he does not have a preference about whether the vote should be by a voice vote or roll call vote; encouraged the applicants not appointed to run for office in 2004. Vice Mayor Daysog thanked the applicants and the members of the committee that he formed to review the applicants. Vice Mayor Daysog nominated Jean Sweeney. Councilmember Kerr seconded the nomination, which FAILED by the following roll call vote: Councilmembers Daysog: Aye; Kerr: Aye; Matarrese: No; and Mayor Johnson: No. Ayes: 2. Noes: 2. Councilmember Kerr nominated Doug deHaan. THE NOMINATION FAILED due to lack of a second. Councilmember Matarrese nominated Marilyn Ezzy Ashcraft. Mayor Johnson called a recess at 8:45 p.m. and reconvened the Special Meeting at 8:55 p.m. Mayor Johnson stated the only consequence of not meeting the 60 -day Charter requirement is that Council forfeits $50 per meeting. Special Meeting Alameda City Council 5 August 26, 2003 Councilmember Matarrese inquired whether there were other options. The City Attorney stated the City Charter does not describe the process; three votes of the Council can adopt the process; the Council previously voted [at a Special Meeting July 22, 20031 to consider only the thirteen applicants; the Charter merely requires three votes to appoint someone and that the person appointed be a registered voter of the City of Alameda. Councilmember Matarrese stated that he was not suggesting going beyond the applicants. Councilmember Matarrese nominated Marilyn Ezzy Ashcraft. Mayor Johnson seconded the nomination, which FAILED by the following roll call vote: Councilmembers Daysog: No; Kerr: No; Matarrese: Aye; and Mayor Johnson: Aye. Ayes: 2. Noes: 2. Mayor Johnson stated that she would not make another nomination. Vice Mayor Daysog nominated Jean Sweeney. Councilmember Kerr seconded the nomination, which FAILED by the following roll call vote: Councilmembers Daysog: Aye; Kerr: Aye; Matarrese: No; and Mayor Johnson: No. Ayes: 2. Noes: 2. Special Meeting Alameda City Council 6 August 26, 2003 Vice Mayor Daysog seconded the nomination, which FAILED by the following roll call vote: Councilmembers Daysog: Aye; Kerr: Aye; Matarrese: No; and Mayor Johnson: No. Ayes: 2. Noes: 2. Vice Mayor Daysog suggested a short list [narrow field of applicants] be created and the matter return in two weeks. Councilmember Kerr concurred with the suggestion; noted that she would be away the week of September 7 to attend the Annual Meeting of League of California Cities. Vice Mayor Daysog suggested the date of Thursday, September 4, 2003. Mayor Johnson inquired whether the Council would be available September 4, to which the Council responded in the affirmative. The Council did not approve Vice Mayor Daysog's suggestion to create a short list.
