2000-02-01 Joint CC CIC MinutesMINUTES OF THE SPECIAL JOINT CITY COUNCIL AND COMMUNITY IMPROVEMENT COMMISSION MEETING TUESDAY- - FEBRUARY 1, 2000- -7:15 P.M. Vice Mayor /Vice Chair Daysog convened the Special Joint Meeting at _7:26 p.m. Councilmember /Commissioner Johnson led the Pledge of Allegiance. Reverend Jack Buckley, First Presbyterian Church, gave the invocation. ROLL CALL - Present: Councilmembers /Commissioners Daysog, DeWitt, Johnson and Kerr - 4. Absent: Mayor /Chair Appezzato - 1. AGENDA ITEM (CC 00 -47) (CIC 00 -01) Recommendation to approve amendment of the Alameda Reuse and Redevelopment Authority (ARRA) Joint Powers Agreement (JPA) to remove Alameda County as a party to the JPA and add the Community Improvement Commission. Accepted. Richard Neveln, Alameda, stated ARRA was intended to sunset when most of the conversion process was ending, which was envisioned to take no longer than four years; process has taken much longer; regional issues remain around housing; there is a critical shortage of housing in the East Bay; at this time, removing the County is not a proper action; adding the Community Improvement Commission (CIC) makes the City Council on JPA twice; requested the Legal Advisor to explain how the CIC and City Council could be on the same board twice. Vice Mayor /Vice Chair Daysog requested a brief overview of the matter. The City Manager noted the County Board of Supervisors approved the dissolution of the JPA today. The Deputy City Manager stated the [proposed] action stems from the decision made by ARRA in April, 1999: no later than February 1, 2000, provided there were no adverse consequences, ARRA would be reconstituted to be comprised of just the five City Councilmembers; there are regional criteria for eligibility of grant funding for infrastructure needs; the action is acceptable to the Navy as long as ARRA remains the reuse authority. Vice Mayor /Vice Chair Daysog requested the City Attorney to address Mr. Neveln's comment regarding the CIC being added. Special Joint Meeting Alameda City Council and 1 Community Improvement Commission February 1, 2000 The City Attorney /Legal Counsel stated it is hard to imagine, but the audience has to think of the Councilmembers as wearing different hats; when wearing different hats, they are absolutely a different entity even though they look the same; the Council is under the City Charter; the CIC is the redevelopment agency for the City and is under an entirely different set of laws; in addition, the CIC is the entity which is going to receive the Fleet Industrial Supply Center (FISC) and be the interim developer and decision maker on the disposition of the FISC and possibly Alameda Point; it is legally permissible. Vice Mayor /Vice Chair Daysog inquired whether the CIC would receive the FISC because of federal legislation on rapid turn over of the FISC site. The City Attorney /Legal Counsel responded FISC and Alameda Point are under separate transfers; the disposition of FISC will happen significantly earlier; ARRA and the City Council have voted to transfer FISC to the redevelopment agency [CIC]; the redevelopment agency was formed in the area; the action has been taken to have the transfer go quickly and smoothly. Councilmember /Commissioner Kerr stated there was a distinct fall off of interest from outside agencies; initially, people who were appointed from other jurisdictions attended meetings; there have been substitutes for a long time, including someone from El Cerrito, which is not even in the County, and residents of Berkeley and San Leandro, who were voting on what happens in Alameda; given the fall off of interest, it is a good time to transfer the decision making back to the people of Alameda. Councilmember /Commissioner Johnson stated the long, on -going process has involved not just ARRA members, but the many members of the Base Reuse Advisory Group (B.R.A.G.) and B.R.A.G. subcommittees; many residents of Alameda have participated in the Base reuse process; regional members role will be terminated; it was beneficial to have a regional body, however, the time has come when it is not needed anymore; Councilmember DeWitt sits on the Oakland's Base Reuse Authority; there is regional activity in other cities; everyone worked together to make the Base reuse process as best as possible for the region and its economy; thanked everyone involved. Councilmember /Commissioner DeWitt stated that he appreciated Congresswoman Barbara Lee for providing a representative on the Board; the City has received a lot more grant money because of Congresswoman Barbara Lee's representative Sandre Swanson, [Alameda County Supervisor] Wilma Chan, San Leandro's Mayor and an Oakland Special Joint Meeting Alameda City Council and 2 Community Improvement Commission February 1, 2000 representative; it has been nothing but positive for the City of Alameda; the job is not done yet; B.R.A.G. will continue to exist. Vice Mayor /Vice Chair Daysog stated the City received tremendous help from the region; Alameda County Supervisor Wilma Chan assisted Alameda in lifting the seaport designation for a critical part of the Naval Air Station; regional alliances will continue after the change in the ARRA body. Councilmember /Commissioner Kerr moved approval of the staff recommendation. Councilmember /Commissioner DeWitt seconded the motion, which carried by unanimous voice vote - 4.
