2000-09-05 Regular CC MinutesMINUTES OF THE REGULAR CITY COUNCIL MEETING TUESDAY - - SEPTEMBER 5, 2000 - - 7:30 P.M. Mayor Appezzato convened the Regular Meeting at 10:34 p.m. ROLL CALL - Present: Councilmembers Daysog, DeWitt, Johnson, Kerr and Mayor Appezzato - 5. Absent: None. AGENDA CHANGES None. PROCLAMATIONS, SPECIAL ORDERS OF THE DAY AND ANNOUNCEMENTS (00 -491) Presentation by Charles Foster, Port of Oakland, of Pacific Gateway: An Illustrated History of the Port of Oakland by Woody Minor. Mayor Appezzato announced that the Presentation was rescheduled to a later date [September 19, 2000 Regular Council Meeting]. CONSENT CALENDAR Mayor Appezzato announced the recommendation to approve City's Response to 1999 -2000 Alameda County Grand Jury Report [paragraph no. 00 -4931 was removed from the Consent Calender for discussion. Councilmember DeWitt moved approval of the remainder of the Consent Calender. Councilmember Kerr seconded the motion, which carried by unanimous voice vote - 5. [Items so enacted or adopted are indicated by an asterisk preceding the paragraph number.] ( *00 -492) Minutes of the Special and Regular City Council Meetings held on August 15, 2000. Approved. (00 -493) Recommendation to approve City's Response to 1999 -2000 Alameda County Grand Jury Report. Peggy Doherty, Alameda, suggested City work shops on the Brown Act include the public. Mayor Appezzato noted the Fair Political Practices Commission holds public hearings. Regular Meeting Alameda City Council 1 September 5, 2000 Ms. Doherty clarified that her suggestion was referring to the in- service work shops for the City staff and City Council. Councilmember DeWitt moved approval the recommendation to approve the City's response to the 1999 -2000 Alameda County Grand Just Report. Councilmember Kerr seconded the motion, which carried by unanimous voice vote - 5. ( *00 -494) Recommendation to adopt Plans and Specifications and authorize Call for Bids for Alameda Point Buildings 11 and 400A, Phase 2, No. P.W. 01- 00 -01. Approved. ( *00 -495) Recommendation to adopt Amendment No. 1 to FY 2000 -01 Community Development Block Grant Action Plan to include Washington Park Restroom Design and to increase funding for Midway Trailer Acquisition; and authorize execution of Grant Agreements and /or Modifications and related documents. Approved. ( *00 -496) Ratified bills in the amount of $7,405,423.07. REGULAR AGENDA ITEMS (00 -497) Resolution No. 13270, "Reappointing Douglas DeHaan as a Member of the City Economic Development Commission." Adopted. Councilmember DeWitt moved adoption of the Resolution. Councilmember Johnson seconded the motion, which carried by unanimous voice vote - 5. The City Clerk administered the Oath of Office and presented Mr. DeHaan with a Certificate of Reappointment. (00 -498) Resolution No. 13271, "Reappointing Francis J. Matarrese as a Member of the City Economic Development Commission." [Manufacturing /Industrial Seat] Adopted. Councilmember Johnson moved adoption of the Resolution. Vice Mayor Daysog seconded the motion, which carried by unanimous voice vote - 5. The City Clerk administered the Oath of Office and presented Mr. Matarrese with a Certificate of Reappointment. (00 -499) Resolution No. 13272, "Appointing Gail A. Wetzork as a Regular Meeting Alameda City Council 2 September 5, 2000 Member of the City Economic Development Commission." [Community -at- Large Seat] Adopted. Councilmember DeWitt moved adoption of the Resolution. Vice Mayor Daysog seconded the motion, which carried by unanimous voice vote - 5. The City Clerk administered the Oath of Office and presented Mr. Wetzork with a Certificate of Appointment. (00 -500) Resolution No. 13273, "Reappointing Anthony J. Corica as a Member of the City Golf Commission." Adopted. Councilmember Johnson moved adoption of Resolution. Councilmember Kerr seconded the motion, which carried by unanimous voice vote - 5. The City Clerk administered the Oath of Office and presented Mr. Corica with a Certificate of Reappointment. (00 -501) Resolution No. 13274, "Appointing Sandre R. Swanson as a Member of the City Golf Commission." Adopted. Councilmember DeWitt moved adoption of the Resolution. Vice Mayor Daysog seconded the motion, which carried by unanimous voice vote - 5. The City Clerk administered the Oath of Office and presented Mr. Swanson with a Certificate of Appointment. ORAL COMMUNICATIONS, NON- AGENDA (00 -502) Angus McDonald, Alameda, submitted and read a letter from John Cruz, Code Compliance Officer, dated August 30, 2000 notifying him [Mr. McDonald] of an inspection to determine whether his property is in violation of the Alameda Municipal Code; stated the letter does not indicate what the City is looking for; the City does not have a right to enter homes; requested the City Council to direct staff to call residents prior to sending letters. Mayor Appezzato requested the City Manager to speak to Mr. McDonald regarding the matter. Councilmember Johnson inquired whether Mr. McDonald received any indication about the potential [Code] violations, to which Mr. Regular Meeting Alameda City Council 3 September 5, 2000 McDonald responded in the negative. (00 -503) Jon Spangler, Alameda, stated the General Plan update process should involve the highest possible percentage of the people; involvement should not be just in Public Hearings and should allow Alamedans to put together the documents and gather information; requested the City Council to increase the number of meetings proposed for General Plan update; further stated there should be increases based on the 1990 [General] Plan process; the Webster Street Rejuvenation- and Park Street Vision processes should be used as a model; there should be input on the editing and writing level [from citizens], not just from a hired consultant. COUNCIL COMMUNICATIONS (00 -504) Consideration of Mayor's nomination for appointment to the Public Utilities Board. [Engineer seat; partial term expiring 6/30/2002.] Not addressed. (00 -505) Councilmember DeWitt announced that the September 6, 2000 Public Transit Committee Meeting will held be at the Alameda Power & Telecom Conference Room. (00 -506) Councilmember DeWitt stated children are back in school and everyone should drive safely. (00 -507) Councilmember Kerr announced that the Recreation and Parks Department and volunteers have organized the first "Art in the Park" on Sunday, September 10, in Jackson Park; invited everybody to attend the event. (00 -508) Mayor Appezzato announced that the Home Tour would be on Sunday, September 10, and the Meyers Home would be open with proceeds going to the Alameda Museum. (00 -509) Mayor Appezzato announced that Library 2000 will hold a meeting [campaign kick -off] at the Alameda Hotel, on Sunday September 10, from 2 p.m. to 4 p.m.; urged library supporters to attend. (00 -510) Mayor Appezzato stated there was a recent newspaper article about the City of Hayward receiving twelve new bus shelters; Hayward joined the Bus Shelter Consortium which includes AC Transit and the Cities of Albany, Berkeley, Emeryville, Newark and San Leandro; the City of Alameda has an ordinance [prohibiting advertisements on bus shelters]; suggested a Public Hearing be held regarding matter; further stated citizens would not have to pay for bus shelters with tasteful advertising. Regular Meeting Alameda City Council 4 September 5, 2000 Councilmember Johnson stated the installation and maintenance of bus shelters would be paid for; a prior Council voted not to allow advertising on bus shelters; the Public Transit Committee is preparing to make a recommendation [to Council] on said matter. (00 -511) Mayor Appezzato stated that he received letters thanking the City's refuse collector and various City staff; include a letter from the Association of Bay Area Governments (ABAG) thanking the City for its assistance. The City Manager stated that due to the spike in energy costs, ABAG created a power pool serving 55 jurisdictions; the Cities of Alameda and Palo Alto helped ABAG to purchase energy and continue the pool in a financially significant way.
