Resolution 12717CITY OF ALAMEDA RESOLUTION NO. 12717 CALLING A SPECIAL ELECTION IN THE CITY OF ALAMEDA FOR THE PURPOSE OF SUBMITTING TO THE ELECTORS AN AMENDMENT TO THE CITY CHARTER RELATING TO THE NEWSPAPERS QUALIFIED TO PUBLISH THE LEGAL ADVERTISING FOR THE CITY; FIXING THE DATE OF SAID ELECTION, THE MANNER OF HOLDING SAME, AND PROVIDING FOR NOTICE THEREOF; CONSOLIDATING SAID SPECIAL ELECTION WITH THE PRIMARY ELECTION OF THE STATE OF CALIFORNIA TO BE HELD ON TUESDAY, MARCH 26, 1996; AND PROPOSING SAID CHARTER AMENDMENT WHEREAS, the Council of the City of Alameda hereby proposes to submit to the voters of said City an amendment to the City of Alameda Charter concerning the newspapers that are qualified to publish the legal advertising for the City by to be voted upon at the Primary Election of the State of California to be held on March 26, 1996; • NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA THAT: Section 1. The Council of the City of Alameda hereby proposes on its own motion that an amendment to the City Charter be °' submitted to the voters of said City at said election, to read as follows: CITY OF ALAMEDA CITY CHARTER AMENDMENT Sec. 3 -18. The Council shall annually, after advertising in the manner provided for the purchase of supplies, award a contract to the responsible bidder who submits the lowest and best bid for publication of all legal advertising of the City in a newspaper adjudicated to be a newspaper of general circulation within the City of Alameda. The newspaper published by the successful bidder shall be the Official Newspaper of the City. The Council may reject all bids. In lieu of newspaper advertising the Council may issue and publish a bulletin containing such matter as it is required by law to publish, sending the same by mail to the registered voters of the City, to their addresses as the same shall appear on the registration records of Alameda County, and shall also post printed copies of such advertisement in three public places in the City of Alameda. Section 2. This amendment shall be in full force and'effect when accepted and filed by the Secretary of State pursuant to section 34460 of the Government Code. Section 2. The City Council hereby proposes to and does hereby on its own motion, pursuant to the authorization provided by section 34458 of the Government Code, submit the proposal to the qualified electors of the City of Alameda in a special municipal election to be consolidated with and voted upon *at the March 26, 1996, statewide primary election to be held on that date. Section 3. The proposal shall be designated on the ballot as "Proposed Charter Amendment of the City of Alameda" and shall be set forth, as follows: MEASURE: Proposed Charter Amendment of the City of Alameda Shall the Charter of the City of Alameda be amended to require newspapers to be adjudicated as a newspaper of general YES : circulation within the City of Alameda to qualify to publish the City's NO . legal advertisements in lieu of the current Charter requirements that a newspaper have been published for at least one year in the City and that it have a bona fide paid circulation of at least one thousand copies? Section 4. The City Council hereby requests the Alameda County Board of Supervisors (the "Board ") to consolidate the election on the Measure with the statewide primary election to be held on March 26, 1996. Section 5. The Board is hereby requested to make its order and to take such other and further proceedings as may be necessary to effect the consolidation of said election with the statewide primary election all in accordance with the laws of the State of California regulating and providing for the consolidation of elections. Section 6. The Board is hereby authorized and empowered to canvass the returns of the election on the Measure and to certify the results thereof, that only one form of ballot shall be used, and that said consolidated elections shall be held in all respects as if there were only one election. Section 7. The consolidation election shall be held and conducted, election officers appointed, voting precincts designated, candidates nominated, ballots printed, polls opened and closed, ballots counted and returned, returns canvassed, results declared, certificates of election issued and all other proceedings incidental to and connected with the election shall be regulated and done, all in accordance with the provisions of law regulating the statewide election. Section 8. The City Clerk is hereby authorized, instructed and directed to provide the Alameda County Registrar of Voters with all pertinent information and material as required. Section 9. The City Clerk shall publish, or shall provide for the publication of, any notices as required by Division 14 of the Elections Code and in particular section 22835, all as provided by Government Code section 34450. Section 10. Upon completion of the election and canvassing of the ballots and the results declared, the City Clerk shall certify the results of the election in the records of proceedings of the City Council at the next regular meeting. Section 11. The City Clerk is hereby directed to file immediately a certified copy of this resolution with the Alameda County Board of Supervisors and with the Alameda County Clerk. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 5th day of December , 1995, by the following vote to wit: AYES: Councilmembers Arnerich, DeWitt, Lucas, Mannix and President Appezzato - 5.
