Resolution 13464 and Staff ReportCITY OF ALAMEDA RESOLUTION NO. 13464 AMENDING MASTER FEE RESOLUTION NO. 12191 TO INCREASE FINGERPRINTING FEES AND ESTABLISH FEES FOR LIVESCAN WHEREAS, the Alameda Municipal Code and the California Government Code provide that the City Council may set fees for reasonable costs of providing various services by resolution; and WHEREAS, the City Council, at the August 27, 1991 Special City Council meeting directed staff to amend the Alameda Municipal Code to reflect that City fees shall be set by City Council resolution; and WHEREAS, Resolution No. 12191 (Master Fee Resolution), as amended, codifies 0 existing fees for various City services and permits; and LL 0 WHEREAS, the California Department of Justice, in concert with participating 0 local government agencies, administers the Livescan program, an electronic fingerprinting service; and WHEREAS, the Alameda Police Department began participating in the Livescan F°- fingerprinting program in October, 2001; and U WHEREAS, Master Fee Resolution No. 12191, adopted February 4. 1992, established a fee schedule for fingerprinting; and WHEREAS, it is necessary to incorporate a fee schedule which addresses cost recovery associated with providing Livescan. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that Master Fee Resolution No. 12191 be amended by adding Livescan and increasing fingerprinting fees; attached hereto as Attachment A. BE IT FURTHER RESOLVED that all existing fees not inconsistent with fees set forth in this Resolution shall remain in effect. 2002. These groups range from educators and accountants, to applicants for Federal, State or local Civil Service jobs, to volunteers with civic organizations. The California Department of Justice, in concert with participating local government agencies, administers the Livescan program. Through Livescan, the fingerprints of a person scanned into a machine are electronically transmitted to the California Department of Justice, the Federal Bureau of Investigation, or both. The person's identity is verified, and the results of their criminal history check are sent to the entity requesting the check. It is a Livescan program requirement that participating agencies also make the service available to non - residents. The Alameda Police Department began participating in the Livescan program in October of 2001. DISCUSSION /ANALYSIS It takes approximately fifteen (15) minutes to scan a person into the Livescan system, and requires a Police Department employee skilled in fingerprinting to accomplish. Livescan service, as well as traditional ink fingerprint service, is therefore performed by Police Department Jail Personnel, as well as a select group of trained Police Volunteers. The California Department of Justice does not reimburse agencies for the costs associated with providing Livescan. As a result, many agencies do not offer this valuable service to their communities. (The Alameda Police Department is one of only five (5) police departments in Alameda County that provides Livescan/fingerprint service to the public). It therefore rests with the individual agency to incorporate a fee schedule which addresses cost recovery associated with providing Livescan and fingerprinting. Page 2 May 21, 2002 At this time, the City of Alameda charges $12.00 per person for either Livescan or fingerprinting. This fee is substantially lower than other Alameda County agencies. Most agencies charge a higher fee for non - residents. Consequently, a significant number of persons needing Livescan or fingerprint service in the Bay Area specifically patronize the Alameda Police Department, even when those services are available in their own communities. Sixty to seventy -five percent of the persons fingerprinted or Livescanned by the Alameda Police Department are not residents, nor are they participants in Alameda civic programs. The Department is currently in the process of implementing an administrative schedule for providing Livescan and fingerprinting which is congruent with all other Alameda County Agencies who provide these services. However, raising the Livescan and fingerprint fees to a rate consistent with what other Alameda County Agencies are charging would also produce benefits. A rate increase would help defray costs associated with providing Livescan and fingerprint services, and would provide incentive for persons to patronize agencies offering Livescan and fingerprinting in their respective communities. Existing policy does allow for fee waiver for local civic organizations, at the discretion of the Chief of Police. A proposed Livescan/fingerprint fee schedule is attached. BUDGET CONSIDERATION /FISCAL IMPACT During the past fifty days, the Alameda Police Jail Staff Livescanned or fingerprinted 684 persons at $12.00 each, for a total (approximated) cost recovery of $8208.00. Only 209 of these persons were Alameda residents. If the fee for residents were raised to $20.00, and non - residents to $50.00, which is consistent with other Agencies during this same period, the revenue generated would have been $27,930.00. This represents a significant improvement in cost recovery. Alameda Police Jail Technicians earn between $18.00 and $24.00 per hour, and sometimes devote as much as half a work shift, (5 hours), to Livescan and fingerprinting. It is difficult to speculate how much revenue would be generated annually, since the number of persons needing Livescan varies seasonally, and the Department has participated in the program less than one year. A fee increase would clearly improve cost recovery, and enhance the Police Department's ability to continue to provide this important service to the community.
